Many couples assume that because their partner is already in Canada, they must file inland. This is not correct, and making this assumption costs many couples a longer processing time and their right of appeal.

If your partner is in Canada on valid temporary status, you can apply outland

Filing outland while your partner lives with you in Canada gives you: faster processing (16 months vs 25 months), full travel freedom, and the right to appeal a refusal. Under a public policy extended through December 31, 2026, your partner can still apply for a Spousal Open Work Permit (SOWP) after receiving the IRCC acknowledgment of receipt, using LMIA exemption code A74. This means you do not have to choose between work authorization and the benefits of outland sponsorship.

January 2025 SOWP Restrictions: What They Mean for Spousal Sponsorship

Many couples reading immigration news are worried about Spousal Open Work Permit restrictions introduced in January 2025.

Here is the clear answer.

The January 2025 SOWP restrictions do NOT apply to spousal sponsorship applicants

If you are sponsoring your spouse or partner for permanent residence through the family class spousal sponsorship program, your partner remains fully eligible for a Spousal Open Work Permit. Nothing changed for you.

Who the SOWP restrictions do NOT affect

  • Spousal sponsorship applicants (inland or outland) under the Family Class program
  • Inland applicants: SOWP is still available from the time of application submission
  • Outland applicants in Canada with valid status: SOWP is still available after receiving the AOR, under the public policy extended to December 31, 2026
  • Your sponsorship application is not affected in any way by the January 2025 changes to other types of spousal open work permits.

Who the January 2025 restrictions DO affect

  • Spouses of foreign workers who hold LMIA-based work permits (except high-wage positions)
  • Spouses of international students at designated learning institutions (with limited exceptions)

Your partner is in Canada and needs a work permit immediately : cannot wait for the AOR

Inland is the only route that allows a SOWP application at the moment of submission, without waiting for the AOR.
