Inland vs Outland Sponsorship

  • What is the difference between inland and outland sponsorship?

    Inland sponsorship is usually for spouses or common-law partners who are already living together in Canada. Outland sponsorship is usually the Family Class route for a spouse or partner living outside Canada, or for couples who want more flexibility during processing. Both options can lead to permanent residence, but they work differently depending on where your partner is living, whether travel is important, and overall processing times and the complexity of your relationship situation.

  • Which option is usually better if my spouse or partner is already in Canada?

    The best option, inland or outland, is different for each couple and each situation.  We can meet with you to assess the complexity of your relationship situation, the availability of evidence to prove your relationship, your travel plans, and the overall processing times both inside Canada and for the visa post that serves your home country.  We will also factor in the nuances of how the visa post for your home country tends to operate, as some visa posts are more difficult to work with than others.

  • Can my spouse work in Canada while the application is in process?

    If your spouse is living together with you in Canada, in most cases, it is possible for them to apply for an open work permit once you have received the file number for your PR sponsorship application.  This option is available for both inland and outland sponsorship application pathways. There are times when the principal applicant's current work permit is going to expire soon, and quick action needs to be taken to ensure that a new open work permit application is submitted in time for them to continue working while waiting for PR.  This is when expert support is critical - how much is it going to cost you to stop working for several months while you wait for PR?

  • Can we travel while the sponsorship application is being processed?

    Travel outside of Canada during an inland sponsorship application is not recommended, because if the principal applicant is denied entry upon return, the inland sponsorship application will become void.  Travel outside of Canada during an outland sponsorship does not have this same risk, but it's important to understand that a foreign national is never guaranteed entry to Canada.  Once CBSA knows that your spouse or partner is Canadian, it can actually be more difficult to enter the country as you are no longer just a tourist - you have strong ties to Canada. Expert advice can prepare you for your interview with the border officer and help to make the process smoother.

  • What happens if the application is refused?

    If your relationship is legitimate, then your application should not be refused.  The most common reasons for refusal are because couples generally do not understand the level of evidence that is required to prove the nature of your relationship to IRCC. You can't just provide a marriage certificate and expect that things will go well for you. Expert preparation of your sponsorship application ensures that the evidence provided is sufficient to meet the legal test is required for approval, as well as deals with any potential issues in advance, so that IRCC has the tools to approve your application the first time they look at it.
